This End-User License Agreement ("EULA") is a legal agreement between you ("you" or "User") and Binit ("Binit," "we," "us," or "our").
Contact: support@usebinit.com · The Netherlands
By downloading, installing, accessing, or using the Binit mobile application (the "App"), you agree to be bound by this EULA. If you do not agree, do not use the App.
Binit grants you a personal, non-exclusive, non-transferable, revocable license to install and use the App on your Device for personal, non-commercial use, in accordance with this EULA and applicable law. You may not use the App if you are prohibited from doing so under applicable law.
The App is not intended for children under the age of 13 (or the minimum age required in your country). By using the App, you confirm that you meet this age requirement. If you are under 13, you may not use the App.
The App and all associated intellectual property rights are owned by Binit and/or its licensors. This EULA does not grant you any ownership rights in the App.
You own your Content. Binit does not claim ownership over your photos or videos. To function, the App may request permission to access your photo library (including iCloud Photos). You control these permissions in iOS Settings. If you deny or revoke permissions, some or all features may not work.
Important notes about iCloud Photos:
⚠️ Important: The App may offer actions to delete photos or videos. Deleting is your choice and your responsibility. Binit is not liable for the permanent loss of any photos or videos deleted through the App. We strongly recommend maintaining backups (e.g., via iCloud backup or device backup) before using delete features.
Depending on your iOS settings and Apple Photos behavior, deleted items may move to "Recently Deleted" for a period, or may be removed in other ways governed by Apple. Recovery, backups, and retention are controlled by Apple and your device settings — not by Binit.
You may not, and may not permit others to:
Binit may provide patches, bug fixes, updates, or upgrades. Updates may change or remove features. Continued use after an update means you accept the updated App and any updated EULA presented to you.
If the App offers paid features, purchases and subscriptions are processed by Apple — not Binit. Pricing, billing, renewal, and cancellation are governed by your Apple ID settings and Apple's terms. Subscriptions may auto-renew unless canceled at least 24 hours before the end of the current period. Refund requests are handled by Apple under Apple's policies, unless applicable law requires otherwise.
How we handle personal data is described in our Privacy Policy at usebinit.com/privacy-policy. This EULA does not replace the Privacy Policy.
To the maximum extent permitted by law, the App is provided "as is" and "as available." Binit disclaims all warranties, express or implied, including fitness for a particular purpose, merchantability, and non-infringement. We do not guarantee that the App will be uninterrupted or error-free, especially where iCloud or Apple Services influence performance.
To the maximum extent permitted by law:
Some jurisdictions do not allow certain limitations; in that case, the limitations apply to the fullest extent permitted.
This EULA is effective until terminated. You may terminate it at any time by deleting the App and ceasing all use. Binit may terminate or suspend your license immediately if you materially breach this EULA. Upon termination, you must stop using the App and delete all copies in your possession.
This EULA is governed by the laws of the Netherlands, excluding conflict-of-law rules. Any dispute arising out of or relating to this EULA will be submitted to the competent court in Amsterdam, unless mandatory consumer law provides otherwise.
